This CLE hour aims to provide you with a "refresher" on why and how our system of justice admits some evidence and excludes other evidence, even when that excluded evidence seems relevant. We hope to help you approach each case and each trial with a coherent plan on how to evaluate, develop and present evidence at trial. We will touch on the basics of the"sponsorship theory" (Klonoff/Colby), suggesting one simple way to evaluate which evidence you will introduce at trial. We will demonstrate a couple of practical examples for introducing and laying a foundation for introducing certain types of evidence.
