This presentation contains key practice pointers gleaned from many years of conducting administrative adjudications. It outlines specific steps practitioners can “do” to ensure more successful practice and proper procedure in federal administrative law. There are no “don’t” statements presented here because if one is told not to do something, they are actually more likely to do it—at least, they are more likely to hold that command in mind as something to “do.” (If this proposition seems unreasonable, then just “don’t” think of a pink elephant.) To assist practitioners in quickly locating helpful administrative resources (at least with respect to cases brought before the U.S. Department of Labor (DOL)), a non-exhaustive list (with links) is provided at the end of these materials.
